TERMS OF USE

 

1. General Provisions

  1. VICTORIA HAPPY sells Products through the online store at  https://www.victoria-happy.com/

  2.   When placing an order through the online store  https://www.victoria-happy.com// , the User agrees to the terms of sale of the Goods set forth below (hereinafter - the Terms of Sale of Goods). In case of disagreement, the User is obliged to immediately leave the site https://www.victoria-happy.com/.

  3. In accordance with the Civil Code of Ukraine (Art. 633), this provision, as well as all the information indicated on the website https://www.victoria-happy.com/, is a public offer. The Seller reserves the right to unilaterally edit these terms and conditions without notifying the Users.

  4. The user agreement comes into force from the moment the Buyer's order is confirmed by the manager of the online store.

  5. As part of the work, the online store provides the User with information support for the Order.

2. Subject of the agreement

  1. The subject of the Agreement is to enable the User to purchase goods from the catalog of the Internet store https://www.victoria-happy.com/.

3. Product and order of making a purchase

  1. The information provided on the site, namely illustrations, descriptions and characteristics, are not exhaustive and may contain typographical errors. The manufacturer reserves the right to slightly change the appearance of the fittings and related products without notice, depending on the delivery, the texture of the fabric may also slightly differ.

  2. If the ordered goods are not available in the warehouse, the seller has the right to cancel the Buyer's order, while notifying him of this.

  3. The Buyer is fully responsible for providing incorrect information, which resulted in the impossibility of proper execution of the Order.

  4. In case of cancellation or absence of a prepaid Order, the cost of the canceled Goods is returned to the Buyer to the card account.

  5. After placing the Order, the Buyer is provided with information to the specified e-mail address about the selected product and the details for payment. The expected date of dispatch is negotiated when the order is confirmed by the manager of the online store.

4. Delivery of the order

   1. The goods are delivered by the transport company "New Mail" or "Ukrposhta" to choose from in the form of mail.

 

Delivery in Ukraine:

- delivery by the "New mail" service - to an office in your city at the rates of New Mail

- targeted delivery by the "New Mail" service in your city at the rates of New Mail

- delivery by Ukrposhta service - according to Ukrposhta tariffs

On average, the delivery time by "Nova Poshta" to the warehouse of "Nova Poshta" is 1-2 days.

On average, the delivery time by Ukrposhta is  4 - 8 days.

 

After sending your order, an SMS will be sent to your mobile number specified in the registration data with the declaration number of New Mail (required to receive the parcel) or with the number of the Ukrposhta dispatch.

Delivery to other countries:

Delivery is made by "Ukrposhta" postal parcel, international dispatch, air transport.

Delivery cost outside Ukraine - 700 UAH (international mail up to 2kg)

After sending your order to your mobile number, the e-mail specified in the registration data, an SMS will be sent with the Ukrposhta sending number.

   2. The online store is not responsible for the work of "New Mail", "Ukrposhta", as well as other third parties.

   3.Prepaid orders, but not picked up on time, are re-sent, subject to compensation for transport costs ("New mail" services for delivery in both directions). Or, by agreement of the parties, a refund for the order will be made to the buyer's card account minus transportation costs.

   4. If the client does not pick up the parcel within the free / guaranteed storage period (5 working days) at "Nova Poshta", all subsequent orders are sent only in case of full prepayment.

   5.When ordering goods from UAH 2,500.00 and in full prepayment, the goods are delivered free of charge on the territory of Ukraine. In case of payment for the order using the "Cash on Delivery" service, the Buyer shall additionally pay on the spot for the "New Mail" service.

 

5. Payment for the goods

PAYMENT FOR THE ORDER WITHIN UKRAINE

The manager will provide you with payment details after confirming the order.

Payment for goods:

  • Bank card Visa and MasterCard

  • Cash on delivery TC "New Mail", "Ukrposhta", the recipient pays a commission (2%)  for transferring money. 

  • Payment to a Privat Bank card through a terminal or cash desk "PrivatBank", application Privat24

6. Return of goods and money

  1. Unsuitable goods can be returned within 14 days from the date of receipt of the order.

  2. To return the goods, you must contact the managers of the online store at the indicated phones (098) 426-91-32 and write to the corporate mail Victoria-happy@ukr.net and provide the following necessary information for the return: order number and date, full name. A., item number, reason for return. Check the presentation and integrity of the returned products and packaging (the presence of intact labels, tags, packages with a barcode; absence of traces of wear, stains and other contamination). Products with signs of use and not meeting the requirements above are not returned.

  3. Non-returnable items: underwear, bodysuits, corsets, swimwear; nightgowns, pajamas, dressing gowns, home suits; hosiery; gloves, mittens.

  4. Return and exchange of goods is carried out through the Transport company "New Mail". The address for sending in case of exchange / return - Kiev, New post office №122, (Vatslav Havel boulevard, 50), FOP Ignatieva Victoria Vladimirovna, +38 (098) 426-91-32.

  The goods you want to return must be sent without cash on delivery along with a completed form for the exchange / return of goods. All the necessary information for sending the goods is indicated in the form.

   5.Return and exchange of goods is possible only on the territory of Ukraine.

   6. After receiving the item, we will check its integrity and send you the replacement you have chosen or refund the amount of the return according to the invoice to the bank account provided by you. The timing of the exchange depends on when we receive the returned parcel from you, after receiving a notification from Nova Poshta about the arrival of the return, within 2 business banking days, we will send you a replacement for your return. The payment deadline is 10 business banking days after we receive the parcel.

   7.All costs associated with the return / exchange of good quality goods purchased in the online store www.victoria-happy.com are borne by the buyer.

 

7. Responsibility

  1. The Seller is not responsible for damage caused to the Buyer as a result of improper use of the Goods purchased in the online store.

8. Confidentiality and information protection

  1. The User's personal data are subject to processing in accordance with the Law of Ukraine dated 01.06.2010, No. 2297-VI "On the protection of personal data".

  2. Personal data is collected solely for the purpose of complying with the requirements of current legislation and competently fulfilling obligations to Users. The period of storage and processing of personal data is 5 years.

  3. When registering on the Site, the User provides the online store with the following information: full name, valid, e-mail, contact phone number and address for receiving mail. By providing his personal data when registering on the Site, the User agrees to their processing in accordance with the established legislation and the internal provisions of the Internet store.

  4. The Seller is not responsible for the information provided by the User on the Site in a public form.

  5. The Seller has the right to record telephone conversations with the User. At the same time, the Seller undertakes: to prevent attempts of unauthorized access to information obtained during telephone conversations, and, according to the Law of Ukraine dated 02.10.1992, No. 2657-XII "On Information", to transfer it to third parties not directly related to the execution of Orders.

9. Validity period

  1. This Public Offer comes into force from the moment it is published on the website of the online store and is valid until it is revoked.
